The restaurant business is extremely tough in California which has many labor laws favoring the worker. Small businesses which have limited staff can not always give their employees rest breaks nor meal breaks at the specifc time stated in the law books since there are no substitute employees to take over. There is no way to predict when the customers are coming in & how long they will stay so all the workers as well as the owners must work until the number of customers subside.
I’m sure there are unscrupulous owners who will abuse their employees in terms of overtime or forcing workers to work without any breaks, but there are ethical owners who will try to compensate the workers for the times when they couldn’t go on breaks because there were so many customers to take care of. California labor laws for small businesses should be more flexible to reflect the realities of running a small business which has a limited pool of employees.
There are also unethical employees who will abuse the labor laws and say they were not properly compensated when they actually were. There are all sorts of disputes between owners & workers which would end up in court w/​expensive lawyers’ fees. APADRC acts as the third person mediators for both sides acting as intermediaries going back & forth to each side to slowly find & suggest resolution.
I was present as a witness & friend of the owner at the arbitration session at APADRC and was impressed by the neutral, impartial way the dispute was mediated. The arbitrator was extremely bilingual in being proficient in English as well as the target language that would be most understood by the interested parties. I’m sure there are various arbitrators who would be bilingual in other Asian Pacific languages. This organization provides an extremely vital function & service to Asian Pacific businesses.
